The opinion of the court was delivered by Defendant, Terry L. Hedger, appeals from his conviction of one
count of murder in the second degree, K.S.A. 21-3402. The victim
was defendant's wife, Joanne Hedger, and the defense was that the
shooting was an accident or mistake. We affirm. Defendant does not deny that he fired the shot that killed his
wife but contends he did so accidentally or by mistake. Defendant
asserts that (1) the trial court erred in admitting evidence of
prior violent incidents between defendant and his wife; (2) the
trial court erred in admitting into evidence gruesome photographs
and a videotape of the victim's body; and (3) the evidence was
insufficient to support the verdict. The facts will be set forth
in some detail.
